A joint inspection of this facility was conducted with OSMRE and Alden Resources, LLC representatives. During the inspection potential mitigation alternatives were discussed in the event that the landslide at pond 103 is not accessible for material removal. On site we discussed the permittee constructing stream channels in wet areas in the backfill where a stream may have existed prior to pre-SMCRA mining (item 1 and 2). TDEC also identified a potential stream draining down a landslide that occurred prior to mining activity (Item 3). This slide is closer to the haulroad and may present a mitigation opportunity if stabilized and a stream channel constructed. TDEC staff also identified a small secondary slide occurring 100 feet west of the primary slide.
Impacts for the small secondary slide are 40 feet along the left descending bank and a 400 sq ft area in the feature. Impacts for the primary slide are 136 feet along the left descending bank and a 5,000 sq ft area.
TDEC will continue to work with the permittee to develop a CAP plan to repair and/or mitigate for the impacts to waters of the state as required in the April 10, 2023 notice of violation. If the permittee chooses alternative mitigation for the landslides, at minimum the primary and secondary slide must be stabilized and vegetated. Further material must be prevented from entering waters of the state.
