This facility was inspected on April 01, 2022, by TDEC Inspectors Bonnie Craighead and Chris Pracheil. A follow-up inspection was conducted on April 7, 2022 by TDEC Inspectors Bonnie Craighead, Chris Pracheil, and Daniel Lawrence. TDEC staff Bryan Epperson, Roxanne Riley, Paul Sainato, and Kevin Hembree were also present, along with OSMRE staff’s Mark Snyder, Mike Castle, and Chris Miller. At the time of the inspections wastewater treatment systems were not installed as depicted in the Division approved NPDES permit site plan. Coal mining and land stripping were actively occurring on site without appropriate wastewater and storm water treatment structures. On April 1, 2022 wastewater was actively leaving the site through a fracture/sinkhole in the mine bench and the mining foreman was aware of the issue. On the April 7, 2022 inspection the foreman had dug a sump to catch the wastewater, but the sump also contained fractures that drained the water subsurface.

In addition, erosion and sediment control best management practices (BMPs) such as berms, ditches, sumps and silt fences are not properly installed or maintained at this facility. BMPs are overwhelmed with sediment and material, leading to discharges or potential discharges of sediment off the site.
TDEC inspectors discussed issues and required improvements with the mine foreman (Gary Rose) while on site on April 1, 2022, and April 7, 2022.
