This site was inspected on December 20, 2021 as a follow-up to an incomplete NPDES application and recently submitted hydrological determination. At the time of inspection material was being removed from the site, and processing equipment was on site. The equipment was not in operation at the time of inspection. A berm was constructed along the haul road to route water to a sump. Brush and some rock have entered the stream and wet weather conveyance feature at the base of the haul road slope. The slope should be stabilized to prevent more material from entering the portion of the feature that is a stream, and existing brush and rock removed from the stream. A vegetated buffer should be established between the stream and the slope, and best management practices such as silt fence, ditches, or berms installed as necessary to prevent further migration of material into the stream. Sediment has the potential to be discharged from the site via the stream/wet weather conveyance draining to karst topography, so any material containing sediment should be removed from the stream and wet weather conveyance. Any rock and brush that has the potential to move into the stream should also be removed. This facility is out of compliance for mining without an NPDES permit. The permittee has applied for an NPDES and surface mine permit and will be returned to compliance once all appropriate permits are received.
