Complainant states that property is being cleared and trees are being tossed in the Nolichucky River at Red Banks in Erwin. It was stated that equipment was seen tearing down trees on the cliff and throwing them in the river. A site visit was conducted on 9-6-2024. Contractors were on site at the time of the visit. Trees had been removed with stumps remaining. No visible trees were seen in the river or at the base of the cliff. The contractor said he had not let anything go over the cliff to his memory. There had been less than an acre of grading conducted. There was a pile of tree actively being burned in the center of the property away from the cliff's edge. The contractor was informed to finish removing piles of old building materials and to pull back and smooth out the dirt. Then to install erosion controls (silt fence) about 5 feet from the cliff edge. The contractor was provided a CGP application package and associated document to give to the property owner. The contractor was then informed that if the clearing and grading continued and exceeded one acre a CGP permit would need to be acquired.
