    6/17/10, Complainant received a call from personnel on the TDOT bridge construction site that a contractor working on the Hemlock site was pumping muddy water directly into Spring Creek. The stream was muddy due to the discharge. The contractor is believed to be DeWitt Contractors, working on a sewer line project for the Clarksvile Gas & Water Dept. I requested they get photos if possible. He called back later after he arrived at the site. He got photos on his cell phone. The contractor has three pumps running, he observed muddy water pumped directly into the creek. AER

    On 06/17/2010 I investigated the complaint and observed T J Construction pumping muddy water from two constructed pits straight into Spring Creek. Based on the paperwork maintained on-site T J Construction is the contractor hired by the City of Clarksville's Water and Gas Department to install natural gas lines to support the HSC site. During my investigation I spoke with T J Construcion's project manager, Lea Munsey, who was able to show me all of the applicable paperwork that is required by both the CSW and ARAPs to be maintained at the site. I explained to Ms. Munsey that pumping their pit water directly into Spring Creek was a violation of their ARAP and encouraged her to use the sediment treatment ponds that they had installed adjacent to their work area. Prior to returning to the office I telephoned Pat Hickey with the City to notify him of the violations that I had observed and explained to him that formal correspondence to that fact via a NOV may be forthcoming. - AMM
