Complainant states that a stream has been dammed up and that the area around the base of a waterfall is being excavated. The property is being cleared for residential development.
Greater than one acre of land has been disturbed without CGP coverage. A wall has been constructed around the pool below the waterfall. It is unknown if any of the original pool has been excavated or filled to accommodate the wall. Morgan Creek has been dammed with large rocks just below the pool so as to raise the water level in the pool itself. We will issue an NOV requesting coverage under the CGP and removal of the dam. The addition of the wall around the pool will be ignored because it is unknown to what degree, if any, the construction of the wall altered the pool. The complainant mentioned the owner was applying a chemical that was killing fish, but no chemicals were found onsite.
