Owner is already subject to two (2) Notices of Violation for Complaint# 127947 and Complaint# 133094 at Site ID# 177362 for removing the Saunders Fork Creek stream bank, filling the stream bank, installing culverts, and placing a shipping container into the stream as a bridge for a new driveway without approval nor any application for an ARAP permit. Owner has been noticed to cease this activity and obtain an ARAP permit. Owner has not ceased these activities nor obtained an ARAP permit. Owner is now filling the stream bank again with rock and gravel, has not removed the shipping container he placed in the Saunders Fork Creek and has covered the shipping container he placed in the stream with rock and gravel, all without any approval nor application for an ARAP permit. Owner is willfully continuing to violate the Clean Water Act. The Saunders Fork Creek is a major tributary to the Smith Fork Creek and Caney Fork River watersheds draining the Auburntown, TN area. Silt and gravel from this operation is washing downstream, and the streambank has been cleared of all its vegetation without approval nor application for an ARAP permit. Photographs of the continued work in violation are included with this report.
