    Complaint Description and Writeup

    Complaint = The homebuilder on my street has been building new homes for months now which has caused alot of dirt in the streets. They also have dirt lots that are adding to the problem and none of the stormwater inlets are being protected. Dirt, concrete and paint is washing right into the inlets which states it's going into the river.

    On May 31, 2012, I met on-site with Ryan Clinard, Matt Pater, and Dustin Finn with Goodall Inc. Builders in order to investigate the complaint. During the inspection I walked the property, observed several outfalls associated with the site, evaluated the erosion prevention sediment control measures that were installed, reviewed the on-site stormwater pollution control plan(s)(SWPPP) that were available and the certified inspection forms. I noted that the Notices of Coverage for phases 4-16 were not posted on-site. The contact information and location of the SWPPPs for all phases were not provided. The erosion prevention sediment control measures, silt fences and inlet protections on the storm drains, that had been installed were not being maintained allowing sediment laden water to enter the storm drains and eventually discharge into a tributary of the Middle Fork of Cedar Creek . The SWPPP associated with the permitted phases 1-6, 14 and 15 were not on-site. The SWPPP for phases 7, 8A, 8B, 9, 10, 11, 12 and 16 were located in the truck of the contractor, Mr. Brandon Butler with Tennessee Contractors, Inc., I reviewed the SWPPP¿s provided by Mr. Butler and the Erosion Prevention Sediment Control Measures were not installed according to the SWPPP. Additionally, changes had been made on-site and the SWPPP was not being updated to reflect the current Erosion Prevention Sediment Control (EPSC) measures being utilized. The twice weekly inspections were not being conducted in the permitted areas as required. In phases 14 and 15 that had been disturbed for longer than 14 days that were not stable. Disturbed areas must be stabilized when work has temporarily or permanently ceased and will not resume for a period exceeding 14 calendar days. I discussed the inspection forms with them and informed them that these were violations of the NPDES Construction General Permit. I verbally guided them through the process on how they could correct their violations and provided them with inspection forms and the link to our website. I informed them that I would follow up with a letter and a follow up inspection may be required.

    On June 1, 2012, I received a Notice of Intent (NOI) and SWPPP for Stonebridge 17-22 and the borrow area to discharge stormwater associated with construction activities at this site under the Tennessee Construction General Permit. After reviewing the plans submitted for this area and based on my observations during the inspection, land disturbance and construction activities have already started prior to the issuance of the permit.
