    Complaint Description and Writeup

    Caller said that he filed a complaint about a year ago but nothing was done.
    His neighbor has a hole on their property that contractors keep digging into and have been for about a year (there is a tractor that has remained constant on the site)
    He doesn't believe his neighbor is actually aware of what the contractor is doing.
    It's been called a "pond", but he said that they are actually just pulling dirt out of it and using it as a "borrow pit".
    There is mud and dirt transferred all over the road and yard and the hole is unsightly, and very unsafe as someone could fall in and not be able to get out.
    He believes it is affecting Mary's Creek nearby.

    MHBu and DKM1 visited the site on 07-08-24. At the time of inspection there was no sediment observed to be leaving the property or affecting Mary's Creek. DWR staff was unable to make contact with landowner while on site. DWR staff recommends the landowner be vigilant regarding soil leaving the site in the future. DWR will follow up with landowner to clarify the purpose of the borrow pit. Since the disturbed area is less than one acre and the site is not observed to be affecting water resources, this complaint is not within the jurisdiction of the Division of Water Resources.
