1/29/2021 - Concerns for possible alterations to stream at back of property. A pipe is being installed leading up to the stream.
*2/3/2021 - Site is fairly flat, and the building has already been constructed with gravel spread around proposed parking lot. However, SW pipes are currently being installed and silt fence along buffer zone is not well maintained with some minor disturbance into buffer zone. Currently no violations; however, there is high potential for discharge into waters of the state if issues are not addressed immediately. It also appears that a pipe from the pond is being installed to potentially re-route the on-site stream/linear wetland that has previously been encapsulated across the entire site. Currently no discharge into waters of the state. Requesting site visit with MS4.
*2/08/2021 - Met on-site with Knox County MS4, Shannon Sayne, Greg Goin, and Tracy Jones to discuss current site conditions. Site was previously permitted under Knox County when they were a QLP. There is an onsite stream/wetland that has been encapsulated throughout the entire site. An HD was never done on this channel so no ARAP was every applied for. Encapsulation was approved by Knox County not knowing that is was waters of the state. Revisions to the site plans have been submitted to Knox County and approved by Knox County a few years ago that include re-routing the encapsulated portion of the stream into the on-site detention pond. Again, this was approved by Knox County when they originally thought the channel was a WWC but never requested an HD to be conducted. Since the stream is already encapsulated and the plans have already been approved by the county. Knox County will be sending the most recent approved plans to see how to move forward.
*2/23/2021 - Met Onsite with Alex Botezat to discuss options for avoiding stream alterations or getting an ARAP. He will be applying for an ARAP.
*6/9/2021 - Spoke on the phone with Mr. Botezat regarding ARAP. he said that they have not done any work in the pond area and has just worked around it. He will try to get the application to me in the next few weeks. I am emailing him the paperwork because he lost it.
