Both the Cooper Ridge Surface Mine Phase 1 (TN0069736) Outfall 04A and Phase II (TN0070157) were inspected on September 17, 2021 On Phase 1 Outfall 04A was documented discharging. The following items were observed during the inspection:
On Phase II:
• The pond at Outfall 001 has a significant sediment delta. The pond should be cleaned to restore pond capacity. The pond has not been cleaned as required by the Division in Notices of Violation dated May 5, 2021 and July 29, 2021.
On Phase I:
• Outfall 04A was discharging at the time of inspection. A discharge for the second half of September 2021 should be reported in NetDMR.
This facility is out of compliance on Phase I for not reporting discharges from outfall 04A in NetDMR. This facility is out of compliance on Phase II for failure to properly maintain treatment structures.
