TDEC staff, Becky Lenz and Geoff Klein from the Mining Section and Crittenden Stender from the Underground Injection Permit Section, met with Brandon Ramsey from Whaley Construction, LLC. This site has coverage under TMSP Sector J and has an application with the Mining Section for in individual NPDES permit. Additionally it has a UIC permit application that was submitted as well. This site is deemed out of compliance at the time of inspection. A site under the TMSP Sector J may not process rock, this includes but is not limited to rock sorting and crushing. This site was sorting rock during the inspection. This site does not have coverage under the individual NPDES permit yet. It was raining during the inspection and any water falling on the process rock equipment was creating process wastewater. Additionally, the same issues from the TMSP/NPDES inspection on 2/3/2022 were noted. The silt fences need to be properly installed. These are temporary BMPs and more permanent ones such as clean rock armored berms or straw/seeded berms should be installed along the sinkhole boundaries and the outslopes/boundary. With the current grade, there is no way for water to make it back to the treatment structures, it will just travel offsite carrying sediment with it.
