On 2-17-23, facility notified TDEC that a sediment trap structure failed during a significant rainfall event at the site on 2-16-23. This berm failure resulted in sediment loss to the UNT to Bear Creek. On 2-21-23, a 5-day written notice of non-compliance was submitted by the facility which indicated during a significant rainfall event an intermediate sediment trap structure was overwhelmed with rainfall, which stressed the perimeter berm of the sediment trap leading to the berm being breached. The facility estimated that 150 cubic yds of material was lost down to the toe area as a result of the sediment trap berm failure. Immediate corrective actions were taken by the facility to repair the berm and prevent additional sediment loss to the UNT to Bear Creek including repairing the berm, removing sediment deposition accumulated at the toe of slope, placing erosion control matting on the repaired slope, and seeding/strawing disturbed areas. TDEC conducted an inspection on 3-1-23. During this inspection, TDEC observed significant amounts of recent sediment deposition in the UNT to Bear Creek immediately below where the sediment trap berm failure occurred. A corrective action plan will need to be developed regarding how the facility will remediate the deposited sediment in the UNT to Bear Creek.
