Pre-mine inspection by Logan Kennedy and Dan Murray. This site was previously permitted but has expired, and the application is for new permit coverage. During the inspection the Division found that the proposed treatment ponds were connected by surface flow to Waters of the State. The series of ponds proposed to be used is a stream that has been dammed sometime in the past. Aerial imagery shows that the stream has been dammed since at least 1997. It is still fed by at least one jurisdictional stream identified on TDEC and USGS maps as a tributary to Lick Creek. Another borderline jurisdictional feature was identified feeding the ponds, as well. Since the proposed ponds are within jurisdictional waters, it will not be a viable location, and the treatment structures must be constructed elsewhere. No other issues were noted with the site. There was no evidence of mining presently taking place on the property, though the site has been mined in the past.
