Notes
There were two main objectives to the inspection. They are summarized below, but fully detailed in the inspection report.
Objective 1: Routine compliance evaluation inspection
Findings: No issues were noted with the permitted mine area. BMPs are currently in-place and functioning properly. A question was raised about the suitability of Outfall 31.01 for conversion to a stormwater point. This point may be converted, if desired.
Objective 2: Follow-up on past compliance issues (sediment impact to stream)
Findings: significant amounts of sediment still remain in portions of the unnamed tributary to Bear Creek. We request a revised corrective action plan to address the sediment impacts.
The inspection is marked as “out of compliance” until a revised corrective action plan is received. We do not intend to issue a Notice of Violation, as the remaining sediment is believed to be from previous issues for which violations were already issued.
